CMS Releases Final Version of Appendix PP – Technical Corrections and Minor Revisions included in Final Guidance

The Centers for Medicare & Medicaid Services (CMS) has released a finalized version of the State Operations Manual Appendix PP - Guidance to Surveyors for Long Term Care Facilities, dated November 22, 2017. This version of Appendix PP replaces the Advance Copy that was released on June 30, 2017. On Wednesday, December 13th, Mass Senior Care launched its redesigned website featuring improved functionality for members and enhanced consumer resources. Mass Senior Care Responds to End of Temporary Protected Status (TPS) for Haitians

Mass Senior Care's recent letter to the editor at The Boston Globe was published in response to the Globe's article, “Nursing facilities, and their residents, will feel impact if Haitians’ status ends.” Tara Gregorio, Association President and Marva Serotkin, Foundation President say the repeal of the TPS designation will only worsen the impact on skilled nursing facilities and their residents who are already experiencing significant staff shortages, “We need to adopt immigration policies that help ensure that we can meet the care needs of our residents today and in the future and provide a living wage for our dedicated front-line staff.”

Changes to the Standard Survey Process Effective November 28th

MassHealth Payment and Care Delivery Innovations (PCDI) – MassHealth All Provider Bulletin 272

Effective March 1, 2018, MassHealth will begin offering an expanded selection of health plan options to managed care eligible members. These new options are Accountable Care Organizations (ACOs), and a key part of MassHealth PCDI. MassHealth will also continue to offer Managed Care Organizations (MCOs) and the Primary Care Clinician (PCC) Plan as managed care options.

DPH Issues Proposed Revised Regulations 105 CMR 150.000 Standards for Long-Term Care Facilities

As a direct result of Mass Senior Care’s member outreach and advocacy campaign over the last year, we are pleased to report that the DPH’s revised proposed long term care regulations, issued yesterday, retain the current construction ‘grandfather’ protection for homes constructed prior to March 19, 1968 and the regulations will also retain the provision permitting resident rooms to accommodate no more than four residents.

CMS Further Delays Enforcement of New Phase 2 Requirements

CMS announced a partial delay of Phase II of the Requirements of Participation (RoP) rule late last week. The Survey and Certification Group (S&C) at CMS issued two memos just after the Thanksgiving holiday delaying enforcement provisions of the rule, but were short of a complete delay.

Massachusetts Public Health Council Promulgates Revised Regulations for the Medical Use of Marijuana

On November 8, 2017, the Public Health Council promulgated the proposed revisions to 105 CMR 725.000, Implementation of an Act for the Humanitarian Medical Use of Marijuana. This regulation sets forth standards for the medical use of marijuana, the registration of patients, physicians, caregivers, caregiver institutions, and registered marijuana dispensaries (RMDs), and the operation of the RMDs.

MassHealth Issues Letter of Clarification to SCOs in Regard to October 1, 2017 Medicaid NF Rate: Inclusion of Direct Care Staff Payment

In response to a request by Mass Senior Care, MassHealth issued a letter to Senior Care Organizations (SCOs) clarifying that the recently enacted October 1, 2017 Medicaid nursing home rates paid under 101 CMR 206.00/Standard Payments to Nursing Homes specifically include the ‘Direct Care Staff Payment’ as part of the overall reimbursement to facilities.

Legislature Overrides $7.5 Medicaid NF Funding Veto: MSCA Urges Governor to Implement Immediately

Mass Senior Care calls on Governor Baker to immediately implement $7.5 million for critically needed funding for nursing home care. We urge members to continue their tremendous advocacy effort, and to call Governor Baker by participating in the Action Alert. Last week, Mass Senior Care’s Board of Directors sent a letter to Governor Baker requesting the Administration to implement immediately the $7.5 million budget funding authorized by the Legislature on September 28 th as part of a veto override.

National Partnership to Improve Dementia Care - New Goal

On October 2, 2017, the National Partnership to Improve Dementia Care announced that it met its national goal of reducing the national prevalence of antipsychotic use in long-stay nursing home residents by 30 percent by the end of 2016. It also announced a new goal of a 15 percent reduction by the end of 2019 for long-stay residents in those homes with currently limited reduction rates.
